Cloud Cake Cotton Candy LLC, a Texas limited liability company doing business as The Cloud Cake ("Cloud Cake," "we," "us," or "our"), operates thecloudcake.com and the related store, content, products, and services (collectively, the "Services"). This Privacy Policy explains how we collect, use, and disclose personal information when you visit or use the Services, place an order, submit a review or other content, sign up for communications, or contact us.
Personal information we collect
Depending on how you interact with us, we may collect:
- Contact and order information, such as your name, email address, telephone number, billing and shipping addresses, products viewed or purchased, order history, discounts, returns, and transaction details.
- Payment information. Payment-card and other payment details are collected and processed by Shopify and our payment providers. We generally receive payment confirmation and limited transaction information rather than complete card numbers.
- Account information, such as login credentials, preferences, and saved settings.
- Communications and content, including support requests, survey responses, reviews, ratings, names, photographs, videos, audio, and other content you submit.
- Marketing preferences, including email and SMS consent, opt-out status, and interactions with messages.
- Device, usage, and online activity information, such as IP address, browser and device identifiers, pages viewed, referring pages, cart activity, approximate location derived from IP address, and interactions with our Services, advertisements, and messages.
- Inferences, such as likely interests or product preferences derived from the information above.
How we collect information
We collect information directly from you; automatically through cookies, pixels, tags, and similar technologies; from Shopify and other providers that help operate our store; and from advertising, analytics, social-media, review, fulfillment, and business partners.
How we use personal information
We may use personal information to:
- operate, personalize, maintain, and improve the Services;
- process payments, fulfill and deliver orders, provide order updates, and administer refunds, replacements, and customer support;
- create and manage accounts and remember preferences;
- send transactional messages and, with any consent required by law, marketing email through Klaviyo and marketing SMS through Shopify;
- measure performance, understand customer behavior, personalize content, and advertise on our Services and third-party platforms;
- publish, moderate, and use reviews and other user content as described in our Terms of Service, including using a submitted name, image, video, voice, or likeness in marketing when the applicable content license permits;
- detect, investigate, and prevent fraud, security incidents, illegal activity, and policy abuse;
- comply with law, respond to lawful requests, resolve disputes, and enforce our agreements; and
- evaluate or complete a financing, merger, sale, reorganization, or other business transaction.
Cookies, analytics, and targeted advertising
We and our providers use cookies and similar technologies to keep the store working, remember choices, measure traffic and performance, understand shopping activity, and provide or measure advertising. These providers may include Shopify and advertising or analytics platforms such as Meta, Google/YouTube, TikTok, and Pinterest, depending on the tools currently enabled.
Some privacy laws call certain disclosures for cross-context behavioral or targeted advertising a "sale," "sharing," or "targeted advertising." Depending on where you live, you may opt out through our Your privacy choices page. Where required, we also process a supported Global Privacy Control signal as an opt-out request for the browser or device sending it. We do not knowingly sell personal information for money.
How we disclose personal information
We may disclose personal information as reasonably necessary to:
- Shopify, which hosts the store, processes transactions, supports customer accounts and SMS, and provides store, advertising, fraud-prevention, and personalization features. Shopify may process information as described in its own consumer privacy policy.
- Service providers, including Klaviyo for email marketing, Loox for displaying and managing existing reviews, payment processors, fraud-prevention providers, analytics providers, customer-support tools, hosting and technology providers, fulfillment partners, and shipping carriers.
- Advertising and business partners that help deliver, personalize, or measure advertising and campaigns.
- Authorities and other parties when reasonably necessary to comply with law, legal process, or lawful requests; protect customers, the public, or our rights; investigate wrongdoing; or enforce our agreements.
- Transaction participants in connection with a financing, merger, acquisition, reorganization, bankruptcy, or sale of some or all of the business.
- Other parties at your direction or with your consent.
SMS opt-in data and consent will not be sold or shared with third parties for their own marketing. We may provide that information to Shopify, carriers, and other providers that help operate and support our messaging program.
Reviews and public content
Reviews, submitted names, photographs, videos, and other content you choose to post may be displayed publicly. Once information is public, other people may view, copy, or use it. Our right to use submitted content is also governed by the User Content section of our Terms of Service.
Your choices and privacy rights
You may unsubscribe from Klaviyo marketing email using the link in a message. You may opt out of Shopify marketing SMS by replying STOP; reply HELP for help. Opting out of marketing does not stop necessary transactional or service messages.
Depending on where you live and subject to applicable exceptions, you may have rights to request access to, correction of, deletion of, or a portable copy of personal information; to opt out of sale, sharing, or targeted advertising; to limit certain uses; or to appeal our response. Submit a request at support@thecloudcake.com or use the controls made available through the Services. We may need to verify your identity and authority before completing a request. An authorized agent may submit a request where permitted by law. We will not discriminate against you for exercising a privacy right.
Children's privacy
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. We do not knowingly sell or share for targeted advertising the personal information of anyone under 16. A parent or guardian who believes a child provided personal information may contact us to request deletion.
Security and retention
We use reasonable administrative, technical, and organizational measures designed to protect personal information. No method of transmission or storage is completely secure. We retain information for as long as reasonably necessary for the purposes described above, including to provide the Services, maintain business and tax records, prevent fraud, resolve disputes, and meet legal obligations.
International processing
We and our providers may process personal information in the United States and other countries. Where required, transfers will use a legally recognized transfer mechanism.
Third-party services
The Services may link to third-party sites or services that we do not control. Their privacy practices are governed by their own notices.
Changes to this policy
We may update this Privacy Policy to reflect changes in our practices, technology, or legal obligations. We will post the revised version, update the date above, and provide any additional notice required by law.
